Terms

Effective August 30, 2026

These Terms govern your use of riverandrail.app. Project work, hosting, maintenance, applications, AI reception, and other paid services are governed by the proposal, statement of work, service agreement, or other contract accepted for that engagement. If a project agreement conflicts with these website Terms, the project agreement controls for that project.

Website use

You may use this website for lawful informational and business-inquiry purposes. You may not attempt to interfere with the website, gain unauthorized access, submit malicious material, impersonate another person, scrape the website in a manner that burdens its operation, or use its content to mislead others about your relationship with River & Rail.

Estimates and published pricing

Prices displayed on this website are starting points, not binding offers. Final price, scope, deliverables, schedule, payment terms, and support obligations are established in a written proposal or agreement. Third-party fees, usage charges, taxes, content production, and work outside the agreed scope may be additional.

Project schedules

Published timelines are typical estimates and depend on project scope, client responsiveness, content delivery, approvals, third-party services, and requested revisions. A project-specific agreement will establish the applicable schedule.

Intellectual property

River & Rail retains ownership of its pre-existing tools, methods, templates, libraries, components, know-how, Railbed technology, River™ Reception technology, and other reusable materials. Client ownership or licensing of project deliverables will be defined in the applicable project agreement. Unless otherwise agreed, clients retain ownership of the original content and brand materials they provide.

Client-provided materials

Clients are responsible for ensuring they have permission to use text, photographs, logos, data, recordings, trademarks, software, and other materials supplied to River & Rail. Clients are also responsible for reviewing and approving factual claims, pricing, policies, regulatory statements, and final content.

Third-party services

Websites and systems may depend on third-party hosting, domains, telecommunications, AI models, payment processors, email, messaging, scheduling, analytics, or other providers. Their availability, pricing, terms, and behavior are outside our control. River & Rail does not guarantee uninterrupted availability of third-party services.

AI and automated systems

AI-generated responses can be incomplete, misunderstood, or incorrect. River™ Reception and other automated systems must be configured with defined boundaries, escalation rules, and human oversight appropriate to the use case. They are not substitutes for emergency services, medical advice, legal advice, financial advice, or other licensed professional judgment.

Customers are responsible for lawful deployment of automated calling, recording, transcription, messaging, data retention, and disclosures within their business. Additional service-specific requirements may be included in the applicable agreement.

No website warranty

This public website and its general informational content are provided “as is” and “as available.” To the extent permitted by law, River & Rail disclaims implied warranties regarding this website, including merchantability, fitness for a particular purpose, and noninfringement. Warranties for paid project work, if any, will be stated in the applicable agreement.

Limitation of liability

To the extent permitted by law, River & Rail will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of this public website. Limitations applicable to paid services will be defined in the relevant agreement.

Trademarks

River & Rail, River™ Reception, Railbed, Railbed Sites, Railbed Apps, Railbed Voice, associated logos, and related branding may be trademarks or service marks of River & Rail. Use of this website does not grant permission to use those marks.

Governing law

These website Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles. Any different venue or dispute terms for paid services will be stated in the applicable agreement.

Changes

We may revise these Terms as our website and services evolve. The effective date above indicates the latest revision. Continued use of the website after a revision constitutes acceptance of the updated Terms.
